Agreement to Terms

These Terms of Service ("Terms") govern your access to and use of Darkest Exiles ("the Game"), developed and published by Cosmik Studios ("we," "our," or "us").

By downloading, installing, or playing the Game, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Game.

License Grant

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the Game for your personal, non-commercial entertainment purposes.

You may not:

  • Copy, modify, or distribute the Game or any part thereof
  • Reverse engineer, decompile, or disassemble the Game
  • Remove or alter any proprietary notices or labels
  • Use the Game for any commercial purpose without our written consent
  • Transfer, sell, or sublicense your rights to the Game

In-App Purchases

The Game may offer optional in-app purchases ("IAP") for virtual items, currency, or other content. By making an in-app purchase, you agree to the following:

  • All purchases are final. In-app purchases are non-refundable except as required by applicable law or Apple's refund policies.
  • Virtual items have no real-world value. Any virtual currency, items, or content purchased or earned in the Game cannot be exchanged for real money or transferred outside the Game.
  • Purchases are processed by Apple. All payment transactions are handled through the Apple App Store. We do not have access to your payment information.
  • Refund requests must go through Apple. If you believe you are entitled to a refund, please contact Apple Support directly.

User Conduct

When using the Game, you agree not to:

  • Use cheats, exploits, automation software, bots, hacks, or any unauthorized third-party software
  • Exploit bugs or glitches to gain an unfair advantage
  • Interfere with or disrupt the Game or servers connected to the Game
  • Attempt to gain unauthorized access to any portion of the Game
  • Engage in any activity that violates applicable laws or regulations

We reserve the right to suspend or terminate your access to the Game if you violate these Terms.

Intellectual Property

The Game and all content, features, and functionality (including but not limited to text, graphics, logos, icons, images, audio, and software) are owned by Cosmik Studios and are protected by copyright, trademark, and other intellectual property laws.

"Darkest Exiles" and "Cosmik Studios" are trademarks of Cosmik Studios. You may not use our trademarks without our prior written permission.

Disclaimer of Warranties

THE GAME IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Game will be uninterrupted, error-free, or free of viruses or other harmful components. You use the Game at your own risk.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, COSMIK STUDIOS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

  • Your access to or use of (or inability to access or use) the Game
  • Any conduct or content of any third party
  • Unauthorized access, use, or alteration of your content or data
  • Loss of game progress or virtual items due to device failure or other causes

IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID TO US, IF ANY, IN THE SIX (6) MONTHS PRIOR TO THE CLAIM.

Indemnification

You agree to indemnify, defend, and hold harmless Cosmik Studios and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with your access to or use of the Game or your violation of these Terms.

Updates and Modifications

We may update, modify, or discontinue the Game or any features at any time without notice. We are not liable to you or any third party for any modification, suspension, or discontinuance of the Game.

We may also update these Terms from time to time. Continued use of the Game after any changes constitutes acceptance of the new Terms.

Termination

We may terminate or suspend your access to the Game immediately, without prior notice or liability, for any reason, including if you breach these Terms.

Upon termination, your right to use the Game will cease immediately. Provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Cosmik Studios is established, without regard to its conflict of law provisions.

Severability

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
